Juvenile Criminal Procedure System: towards a review of the legal system and jurisprudence of the Province of Santa Fe in the period 2021-2023.

Abstract

This article is about an exploratory and descriptive study, with a qualitative approach, that exposes the particularities of the Juvenile Penal System of the Province of Santa Fe, in the period 2021-2023. A review of the legal systems and jurisprudence in force in the current system at the provincial level and in the city of Rafaela was carried out. In specific objectives, it was proposed to survey the organizations that make up this system in the province and specifically in the city of Rafaela, analyze the interventions carried out by the actors involved in the system in relation to the constitutionality of the processes, and observe the interference of interdisciplinary teams in the decisions of juvenile judges. To achieve the objectives, techniques and instruments associated with qualitative and ethnographic methodology were used, to obtain primary sources, a bibliographic survey was carried out with the subsequent preparation of reading sheets and systematization of the information, as secondary sources were used. semi-structured interviews and participant and non-participant observation. The results showed a series of elements referring to the need for a reform and the incorporation of interdisciplinary and the specialty in childhood and adolescence.
