Abstract

The present article maintains that the competence to sue to a Social Work on the part of its affiliate is ordinary and not federal, as an overwhelming majority of the judicial doctrine maintains. This arises from a complete and contextualized reading of law 23.660 (social works law) and law 23.661 (National Health Insurance System Law), whose article 38 is interpreted - almost unanimously - in the sense opposite to that of this work.
